By accessing or using Track My Rentals ("the Service"), you agree to be bound by these Terms of Service. If you disagree with any part of the terms, you may not access the Service.

2. Subscription Terms

Our Service is billed on a subscription basis. You will be billed in advance on a recurring and periodic basis ("Billing Cycle"). Payment will be charged to your credit card through our payment processor.

3. Free Trial

We may offer a free trial period for new accounts. At the end of the trial period, you will be automatically charged for a subscription unless you cancel before the trial ends.

4. Account Requirements

You must:

  • Be at least 18 years old
  • Provide accurate and complete information
  • Maintain the security of your account
  • Notify us of any unauthorized access

5. Acceptable Use

You agree not to:

  • Track My Rentals retains historical data for operational, analytical, and compliance purposes.
  • Upon account termination, users may request the deletion of their personal data, subject to our legal and business retention obligations.
  • We reserve the right to retain anonymized or aggregated data for analytical and business purposes even after an account is deleted.

7. Third-Party Services and Data

Regarding third-party services and integrations:

  • We are not responsible for the accuracy of data imported from third-party services (e.g., AppFolio).
  • We do not guarantee continuous availability of third-party integrations.
  • You are responsible for maintaining necessary permissions and access to third-party services.
  • Changes in third-party APIs or services may affect our Service's functionality.
  • You agree to comply with all third-party terms of service when using our integrations.

8. Intellectual Property

The Service and its original content, features, and functionality are owned by Track My Rentals and are protected by international copyright, trademark, and other intellectual property laws.

9. Data Accuracy and Analytics Disclaimer

You acknowledge and agree that:

  • The Service provides analytics, insights, and recommendations based on available data, but we do not guarantee their accuracy, completeness, or reliability.
  • Any financial projections, analytics, or recommendations are for informational purposes only and should not be considered as financial, investment, or business advice.
  • Track My Rentals does not provide legal, tax, investment, or financial advice. The analytics, insights, and recommendations provided by the Service are for informational purposes only and should not be relied upon as a substitute for professional advice.
  • You are solely responsible for verifying any data, analytics, or recommendations before making any business or investment decisions.

10. Limitation of Liability and Indemnification

Track My Rentals shall not be liable for any damages resulting from:

  • The use or inability to use the Service.
  • Any decisions made based on the Service's analytics, insights, or recommendations.
  • Errors, inaccuracies, or omissions in any data, calculations, or analytics.
  • Investment or business losses related to using our Service.

11. Termination

We may terminate or suspend your account immediately, without prior notice, for any reason, including:

  • Non-payment.
  • Fraudulent activity.
  • Abuse of the Service.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions.

14. Dispute Resolution & Arbitration

Any disputes arising from or relating to these Terms shall be resolved through binding arbitration in the State of California, in accordance with the rules of the American Arbitration Association (AAA).

  • Arbitration will be conducted individually and not as part of a class action.
  • Each party shall bear its own legal costs unless otherwise required by law.
  • By using the Service, you waive your right to a jury trial or to participate in a class action lawsuit against Track My Rentals.

15. Force Majeure

Track My Rentals shall not be liable for any failure or delay in performance due to events beyond its reasonable control, including but not limited to: natural disasters, acts of war, government actions, cyberattacks, internet outages, hosting provider failures, or other unforeseen circumstances.
